OUR VCF ATTORNEYS EXPLAIN NYC VICTIM COMPENSATION FUND BENEFITS

The 9/11 Victim Compensation Fund makes monetary benefits available to people who were disabled as a result of the attacks. Those benefits are designed to compensate the person (and his or her family) for two types of loss: economic and non-economic.

Economic Loss for 9/11 Disabled Persons

Economic loss refers to the impact on a person’s ability to work. It includes missed current and future wages, as well as other benefits typically stemming from employment. Our VCF attorneys have seen these benefits, which are calculated based on factors like age, salary and extent of disability, total in the hundreds of thousands to millions of dollars.

VCF Attorneys for 9/11 Non-Economic Loss

Non-economic loss is related to pain, suffering and any decrease in a person’s quality of life as a result of 9/11-related injuries, illnesses or medical conditions. These losses typically increase along with the severity of the injury or disability.

ELIGIBILITY REQUIREMENTS FOR DISABILITY BENEFITS

A person seeking compensation for a disability must prove that he or she has a physical condition that has made the person disabled on a temporary or permanent basis. The person also has to show that the condition was caused by the 9/11 attacks. Our VCF attorneys can help with both.

The condition and disability must be certified by an entity such as workers’ compensation board, the Social Security Administration, local agencies like the NYPD, NYCERS or FDNY, a private insurer, private physician, or through the World Trade Center Health Program disability evaluation process.

A person who is seeking or is receiving VCF disability benefits can also seek workers’ compensation, Social Security and similar benefits for their injuries and conditions. The total amount of VCF benefits the person receives, however, may be reduced based on the amount received through other programs.
